06/07/11 - MAGENTA MOON LAUNCHES LOCAL PRESENTATION SEMINARS ON THE AGENCY WORKERS REGULATIONS 2011

 

This is your opportunity to register your interest in a series of presentation seminars regarding the forthcoming Agency Workers Regulations, coming into force on 1st October 2011.

 

Recent business articles in the national press suggest that many business are unprepared for the new legislation:

 

Many companies that regularly use agency workers hired on a temporary basis have done no preparation for new rules on the rights of such staff that are due to come into force in less than four months' time, new research suggests. A survey by the recruitment agency de Poel suggests that 40 per cent of businesses have yet to plan for the Agency Workers Directive, new regulations that become law on 1 October.” (Business Editor, The Independent, 06 June 2011).

 

The Regulations will introduce a principle of equal treatment for agency workers after 12 weeks assignment to the same client company.

 

Magenta Moon has been awaiting final guidance from the Government for all employers (and particularly recruitment agencies). Now this guidance has been published, Magenta Moon will be launching a series of local presentation seminars dealing with the legislation, its implications, and its pitfalls. Attendees will be provided with all the information they need to understand and embrace this important new legislation, and allow full compliance with the law. And that compliance is paramount, as the eventual penalties for non-compliance will be considerable.

 

Each presentations seminar will deal with the following aspects of the Regulations:

 

1.    Who is affected?

2.    Employment Status.

3.    Equal Treatment (annual leave, sick pay, pay rates, opportunities)

4.    The 12-week Rule.

5.    Terms and Conditions of Employment (‘The Contract’)

6.    Liabilities – Employer or Agency?

7.    Advertising internal vacancies in the workforce.

8.    Avoidance, enforcement, and the risks of non-compliance.

9.    Maternity and Paternity – the changes.

10. Question and Answer session.

11. Take-away information pack.

 

The seminars will be presented by Catherine E Walter; BA (Hons); Assoc. CIPD (CERLAP), HR Business Partner of Magenta Moon. Catherine is a qualified Associate of the Chartered Institute of Personnel and Development. With four years’ industry experience and a postgraduate certificate in Employment Relations, Law and Practice, she is responsible primarily for providing an ongoing support service for clients on employment law and HR matters via telephone, email, and on-site consultation. Together with all supporting documentation, she guides clients through compliance with appropriate legislation and procedures. Catherine regularly holds mediation, grievance, disciplinary, redundancy and appeal hearings on behalf of clients. She is also responsible for the administration and implementation of contract documentation for clients. In preparation for these seminars, Catherine has taken part in a major CIPD initiative regarding the Agency Workers Regulations in London earlier this month.

10/10/10 - Additional public holiday for 2011. 29th April 2011 will be a public holiday to celebrate the wedding of Prince William and Kate Middleton. Remember to check your Contracts of Employment regarding your employees' holiday entitlement. 23/09/10 - National Minimum Wage changes:

As of Friday 1st October 2010, some important changes will be taking effect with regards to National Minimum Wage rates. As usual, there will be increases in the rates (please see below).

In addition to this, the qualification age for the adult rate will drop from 22 to 21. Therefore, any employees aged 21 on the 1st October 2010 who have been on the previous 18-21 rate will need to be increased to the highest rate. Also, a minimum rate has been introduced for the first time for apprentices of £2.50 per hour.

 

The new rates are;

(previously 22+) Age 21+ = Increase from £5.80 per hour to £5.93 per hour.

(previously 18-21) Age 18 -20 = Increase from £4.83 per hour to £4.92 per hour.

Age 16 / 17 = Increase from £3.57 per hour to £3.64 per hour.

Apprentices (aged under 19, or over 19 but in the first year of their apprenticeship) = £2.50 per hour.

It is imperative that you make the necessary changes from the 1st October, as employees are entitled to claim back-pay for any wages paid at the incorrect rate.

02/08/10-The coalition Government plans to scrap the "default retirement age" from October 2011, allowing people to work beyond that age if they choose to do so. From April 2011 the default retirement age, which allows employers to potentially force workers to retire at 65, will be phased out over a six-month period.

01/07/10-The Equality Bill received Royal Assent on 8 April 2010 and becomes the Equality Act 2010.The Act is due to be brought into force in stages from October 2010. However, this may, in part, depend upon the result of the General Election, with the Conservatives announcing their intention, if elected, to drop parts of the Act.
