Terms & Conditions of Employment
All employees must be provided with a written contract by their 8th week of employment. Known as ‘Terms & Conditions of Employment’, this is the minimum legal requirement that any employer must issue regardless of size. It should contain a series of statutory defined points such as Rate of Pay, Disciplinary & Grievance Procedures, Holiday Entitlement etc. This forms the employees’ statutory rights, so it is very difficult for an employer to alter anything in this document without the employees consent. For example if you wish to reduce someone’s rate of pay they are unlikely to accept your offer…unless you are offering a pay rise in which case things become a whole lot easier!
We can also produce Sub Contractors Agreements, Temporary / Agency worker Contracts etc etc.
Staff Handbooks
Although not a legal requirement, a Staff Handbook should be implemented by even the smallest of employers. This is a vital document that lays down all of your own working rules & procedures. Standard policies contained within include Mobile Phone / Internet / Driving Policies through to expected levels of attitude & conduct. Industry specific policies will also be incorporated, for example Day Nurseries require Care Standards Policies, Restaurants require Food Hygiene Policies, Haulage companies require Safe Driving Policies, Public Buildings may require a Disaster Plan etc.
As a vital point of reference they resolve many disputes quickly and fairly - as you do not have to struggle with the dreaded ‘verbal’ or ‘implied’ contract argument! As an employer, you will have a safe, legal basis on which to act should a breach of rules occur.
Compliance with the contents of Staff Handbook will be a point contained within the ‘Terms & Conditions of Employment’, and when the two documents are combined they form your ‘Contract of Employment’.
